Caruso's Credit Report!


Companies that offered free credit reports appear to be skirting a new federal disclosure requirement designed to crack down on misleading advertising.

Under the requirement, companies that advertise free credit reports in connection with the sale of credit monitoring or other products must prominently disclose that consumers can get a truly free credit report from the government-authorized Web site annual creditreport.com.

A limited disclosure requirement for all media started in February. A final, more explicit disclosure requirement took effect Friday for print, direct mail, telemarketing and Web advertising. The final rule for TV and radio ads applies Sept. 1.

Rather than make the new disclosure, many companies changed their marketing. Instead of offering free credit reports, some are charging a small fee or promoting free credit scores, which are not covered by the new rule.

Freecreditreport.com, known for its pirates, minstrels and catchy jingles, is doing both. Its Web site now says, "Check your report for $1 and get your score free! Plus, we'll donate your dollar to charity."

The company is owned by Experian, one of three credit reporting agencies required by law to offer consumers a free credit report, with no strings attached, once a year at Annualcreditreport.com.

The company "is cleverly taking advantage of gaping loopholes in the law," says John Ulzheimer, president of consumer education at Credit.com.

If it kept the $1, it might be criticized because it has "free" in its name. By donating the dollar to charity, it blunts criticism and looks generous, he says.

The company's Web ad implies that the government put a stop to its free reports. It says, "Due to federally imposed restrictions it is no longer feasible for us to provide you with a free Experian Credit Report."

Frank Dorman, a spokesman for the Federal Trade Commission, says, "We know of no federal restriction that would prevent a company from offering free credit reports; the rule simply requires those companies that do offer free reports to include prominent disclosures."

Ulzheimer says Experian has changed its signage in sports venues from Freecreditreport.com to Freecreditscore.com.

Experian says it is no longer advertising Freecreditreport.com on television but "will utilize different TV campaigns to advertise our suite of other products including http://www.freecreditscore.com/ and http://www.protectmyid.com/." It had no other comment on its advertising.

Other companies that once advertised free credit reports and scores - including Truecredit.com, owned by credit reporting agency TransUnion - are now promoting free scores only.

The new rules were part of last year's sweeping credit card act. The FTC says it is monitoring compliance with the new rules but cannot comment on any company's advertising.
Starting in February, companies subject to the law had to state, in all advertising, that "Free credit reports are available under federal law at: Annualcreditreport .com."

However, more explicit disclosures applied to print and Web ads.

Web advertising must say: "THIS NOTICE IS REQUIRED BY LAW. Read more at FTC.GOV. You have the right to a free credit report from Annualcreditreport.com or (877) 322-8228, the ONLY authorized source under federal law." The disclosure must include hyperlinks to the two sites.

Starting Sept. 1, TV and radio ads must say, "This is not the free credit report provided for by federal law" in the audio and visual portion.

The law also imposes new restrictions on an nualcreditreport.com, the government-authorized site operated by the three credit reporting agencies.
The first page of this site can no longer have links to the agencies' Web sites. In the past, they could.

"When people clicked on those, they were taken to a site without realizing they were no longer on annualcreditreport .com," says FTC attorney Tiffany George.

Also, this site can no longer advertise any products until after the consumer has received a free credit report.

Caruso's Health Plan!


According to IRS.gov many small businesses and tax-exempt organizations that provide health insurance coverage to their employees now qualify for a special tax credit, according to the Internal Revenue Service.

Included in the health care reform legislation, the Patient Protection and Affordable Care Act, which the credit is designed to encourage small employers to offer health insurance coverage for the first time or maintain coverage they already have.


In general, the credit is available to small employers that pay at least half the cost of single coverage for their employees.

This credit provides a real boost to eligible small businesses by helping them afford health coverage for their employees, and to urge small businesses and tax-exempt employers to look closely at this important tax break - which is already effective - to see if they qualify.

The maximum credit is 35 percent of premiums paid in 2010 by eligible small business employers and 25 percent of premiums paid by eligible employers that are tax-exempt organizations.

In 2014, this maximum credit increases to 50 percent of premiums paid by eligible small business employers and 35 percent of premiums paid by eligible employers that are tax-exempt organizations.

The credit is specifically targeted to help small businesses and tax-exempt organizations that primarily employ low and moderate income workers. It is generally available to employers that have fewer than 25 full-time equivalent employees paying wages averaging less than $50,000 per employee per year. Because the eligibility formula is based in part on the number of full-time equivalent employess, not the number of employees, many businesses will qualify even if they employ more than 25 individual workers.

The maximum credit goes to smaller employers - those with 10 or fewer full-time equivalent employess-paying annual average wages of $25,000 or less.

Eligible small businesses can claim the credit as part of the general business credit starting with the 2010 income tax return they file in 2011. For tax-exempt employers, the IRS will provide further information on how to claim the credit.

The IRS will use postcards to reach out to millions of small businesses that may qualify for the credit. The postcards will encourage small business owners to take advantage of the credit if they qualify.

Caruso's Earth Day Facts!


Did You Know that its Earth Day?

Here are some Earth Day Facts & Figures about Celebrating and Saving Mother Earth!!

Did you know that the first Earth Day was first celebrated on April 22, 1970? At the time, 20 million people got in on the celebration. In 2000, 500 million celebrated Earth Day. In 2009, over 1 billion people in 175 countries around the world will participate in Earth Day celebrations.

Did you know that the Earth's population has grown faster since 1950 than over the previous four million years combined? Today, there are 6.5 billion people living on the planet, with another 74 million people are added every year. Yet just two hundred years ago, there were barely 1 billion people on Planet Earth. The term "population explosion" seems like a ridiculous understatement.

Did you know that greenhouse gas emissions in the United States increased 75 percent between 1970 and 2005? A large part of the problem is the more the doubling of cars and trucks on the road during that same period. Vehicles account for more than half of our air pollution today, even though cars are 20 times more fuel-efficient than they were in the 1970s.

Did you know that the overall rate of recycling in the United States today stands at approximately 28%? That's double what it was a decade ago. By contrast, Austrians recycle fully 60% of their post-consumption waste products. The United Kingdom, on the other hand, has a recycling rate just above 17% and Greece pulls up the European Union rear with an abysmal 10%.

Did you know that recycling just one glass bottle saves enough energy to keep a 100-watt light bulb lit for four hours? Recycling glass uses 40% less energy than making new glass from virgin materials. Glass can be recycled indefinitely and never loses any of its quality.

Did you know that if everyone on Planet Earth lived the way Americans do, we would need 5.3 planets to sustain ourselves? Americans comprise just 5% of the Earth's population, but we produce over 40% of the world's waste. Do you know what your carbon footprint is?
Did you know that Americans recycle 53.4% of the paper products we consume? Even still, Americans throw away an average of 600 pounds of paper per person every year. Recycling just one four foot stack of newspapers is enough to save one 40-foot fir tree.

Did you know that Americans use 2.5 million plastic bottles every single hour? Eight out of 10 of them will end up in a landfill, despite the fact that 63% of American communities now have plastic bottle recycling. It takes 700 years for a plastic bottle to begin to decompose in a landfill.

Did you know that Americans consume enough plastic film every year to shrink-wrap the state of Texas? Less than 10% of communities accept Saran wrap-type plastic for recycling.

Did you know that up to 1 trillion plastic bags are used in America every single year? That's one million bags per minute or 326 plastic bags per person per year. Less than 20% of those bags make it to a recycling center.

Did you know that Americans use well over 2 billion gallons of oil each year to produce its plastic bags? In 2001, Ireland passed a tax on plastic bags and saw a 90% reduction in their consumption. San Francisco recently passed a ban on plastic bags.

Did you know that the process of bottling water is ironically water-intensive? It takes three liters of water to produce just one liter of bottled water. Americans drank 31.2 billion liters of bottled water last year.

Did you know that Americans recycle more than 65% of their aluminum containers? And yet, we still throw away enough beer and soda cans every three months to rebuild the entire U.S. commercial air fleet? Recycling aluminum is incredibly energy efficient -- it uses 5% of the energy that making a new can from virgin materials does.

Did you know that 100 acres of Amazon Rain Forest are being cut down every minute? Who's the Greenest of Them All??


So you want to know who's the greenest of them all......


Los Angeles.

So says a U.S. Environmental Protection Agency (EPA) study that ranked the 25 greenest cities in the United States for 2009.

Where other rankings look at walkabilty, transportation and other measures, the EPA, for its second annual ranking, assessed cities based on the number of efficient buildings that earned EPA's ENERGY STAR label last year.

Los Angeles snagged the top spot, as it did last year, thanks to 293 buildings in the city that earned the ENERGY STAR label during 2009.

The other cites rounding out the top five were Washington, D.C., San Francisco, Denver and Chicago. They were followed by Houston, Lakeland, Fla., Dallas-Fort Worth, Atlanta and New York.

Among the newcomers to the list were San Diego, Calif., Ogden, Utah., Indianapolis, Ind., Des Moines, Ia., Fort Collins, Colo., and Louisville, Ky.

In 2009, nearly 3,900 commercial buildings earned the ENERGY STAR label, representing annual savings of more than $900 million in utility bills and more than 4.7 million metric tons of carbon dioxide emissions, according to the EPA.

Last month, the EPA and the U.S. Department of Energy (DOE) also outlined plans to improve the ENERGY STAR program.

One indication that a change was needed came just after the EPA and DOE announcement.
In late March, a news story broke that indicated that some distinctly un-green-and phony-products received the ENERGY STAR label.

An example of one fake product that got certified was a gasoline-powered alarm clock.
The new approach entails more stringent testing.

For example, the DOE started testing on six of the most common product types, including freezers, clothes washers and room air conditioners, and will test approximately 200 basic models at third-party, independent test laboratories.

The EPA and DOE also will require all products seeking the ENERGY STAR label to be tested in approved labs and manufacturers will have to participate in an ongoing verification testing program to ensure continued compliance.

Going Green with Caruso


Breathe Easier

While reading I came acorss an interesting fact that indoor air quality (IAQ) has become an increasingly important element in home buyers' decision-making, and buyers have become more attuned to mold, radon and other issues that affect air quality.


Many air quality dangers once were invisible and difficult to quantify, but thanks to evolving technology, detecting and rating IAQ has gotten easier. In addition, new programs have emerged to inspect and rate homes' IAQ. One such program is the EPA's Indoor airPlus.


airPlus is a sister label to ENERGY STAR and to get the label, a home first must meet ENERGY STAR requirements. Gaining the airPLUS label requires up to 30 additional home design and construction features, the goal of which is to protect homes from moisture and mold, radon, pest-related contaminants, combustion gases, and other airborne pollutants that affect air quality.


A home is then inspected and verified by an independent third-party to ensure that a home complies with the program requirements.


Some of the illnesses that can stem from or be exacerbated by poor IAQ, include lung cancer and asthma. In an effort to improve IAQ, American consumers spend about $1 billion per year on air cleaners, duct cleaning and IAQ testing.


Although home builders of new homes are most attuned to airPlus, real estate practitioners also play a role in improving the housing stock's IAQ.


Practitioners can:


  • Discuss the potential for better health that comes from living in a house with good IAQ and educate consumers about IAQ.

  • Assess buyers' concerns about IAQ and determine whether it's a priority, and then point them properties that feature the EPA label.

  • Explain the various green home labeling systems and help consumers see what benefits each provides.

In addition, practitioners can become an allied program partner and use the airPlus promotional and educational resources

Wings of Freedom


The nationally renowned Collings Foundation Wings Of Freedom Tour is offering the general public aircrafttours along with flights on famous World War II-era heavy bombers and stick time in a P-51 Mustang long-range fighter plane. The tour will visit the Lyon Air Museum (LAM) at John Wayne Airport in Orange County starting Friday, April 30, through Monday, May 3, 2010.

The Collings Foundation, based in Stow, Mass., is a 501c3 non-profit educational foundation devoted to organizing living history events that allow people to learn more about their heritage and history through direct participation. The nationwide Wings of Freedom Tour is in its 21st year and visits an average of 110 cities in more than 35 states annually. Since its start, tens of millions of people have seen the B-17, B-24 and P-51exhibit at locations throughout the country. The Wings of Freedom Tour travels the nation as a flying tribute to the flight crews who flew them, the ground crews who maintained them, the workers who built them, the soldiers, sailors and airmen they helped protect, and the citizens and families that share the freedom that they helped preserve. Caruso Says....


Life is hectic. Sometimes we're so focused on our jobs and everyday life that we don't just stop and sit for a moment. There are different reasons why we get so caught up in our daily lives but we need to remember that it is always important to take some time for yourself and relax.

Some managers and business owners skipped their vacations last year (and maybe the year before) because they felt the operation couldn't run without them. It's not a good idea for several reasons. First, everyone needs time off to relax and recharge. Second, those who are next in line to run the business become disappointed because you apparently have no faith in them. And third too much work can drive anyone crazy at some point.
So when you do finally take time off, really take it. Don't work all day on your BlackBerry, advises writer Carol Hymowitz because really your not relaxing when your typing away on your phone. One retired CEO says managers should not make themselves indispensible. Managers should take a week or two off instead of three-day weekends. The people in place to run the show while they're gone have been trained to do it and should have the opportunity to show that they can. Thats why we hire staff right? However, that doesn't mean managers should be out of touch completely. Emergencies still require attention. Just decide what they really are.


So stop. Sit back. And go take that long needed vacation. Trust me you'll be happy you took it in the end.

Homebuying with Caruso


Going Solo ~Buying a house is a complex transaction. It should be a team effort. You'll need a real estate agent, lender, inspector, insurer, perhaps a lawyer and other team members to help you through each step of the way. Team build before you start the search.

Love at First Sight ~If you believe in fairy tales you probably shouldn't be buying a home. You won't live happily ever after if you emote your way through the home buying process. Your home should fit your real needs, not your yen for drama. Buy a home that fits your budget and your lifestyle. Be sure the home is in a community and neighborhood you desire. Visit neighborhoods several times before you buy to check out schools, noise and traffic patterns.

'Loanless' Shopping ~Being pre-qualified gives you a general idea of how much you can afford to borrow. It's better to be pre-approved for a given loan. Sellers will take you more seriously. You'll stay on budget. Overbuying Home buyers buying more than they could truly afford, in part, led to the collapse of the housing market. Buy more than you can afford and your dream home will become the same nightmare. Analyze all your monthly costs including debts, food, transportation, entertainment, and savings. Your total monthly debts, including your mortgage, should not exceed 36 percent of your income before taxes. Don't forget to budget closing costs (often two to five percent of the home's purchase price), plus moving, redecorating and maintenance. Look ahead and allow for increases in ongoing expenses such as utilities and taxes.

Misplaced Trust ~You are engaged in what's likely your most valuable acquisition ever. It's a business transaction. Ask family, friends, co-workers, professionals and others you trust for referrals, but don't take their word for it. Vet your team members.

Accepting Oral Agreements ~Get it in writing. The rate lock, the home inspection, disclosures, the contract. Always. Should a dispute arise, you've got the details documented.

Skipping the Fine Print ~Understand what's really in any document before picking up a pen. Get documents in advance, take time to read them and ask questions. Get copies of your mortgage and closing papers a few days ahead of closing.

Forgetting or Betting on Resale ~Avoid buying a home that costs 50 percent more than neighboring homes. Reconsider buying the most expensive home on the block. Neighbors' lower home values will weaken yours. Buy intending to flip your investment only to have the market fail means when it's time to sell your price may not cover your costs.

Making an Unconditional Offer, protect yourself with these contingencies:



  • Mortgage financing. You may be preapproved but is the house? A formal appraisal confirms -- or not -- that there is sufficient value in the home to warrant the loan. If the house appraises lower than the sales price, the loan may be declined.

  • Inspection. Never buy an existing or new home without a thorough home inspection. Walk through the home with the inspector to learn more about the house and any concerns he or she may have.

  • Insurance. Confirm you can get adequate insurance coverage. In some areas, or following certain disasters, it can be difficult to get types of hazard insurance.

Survey Finds...

Survey finds Americans prefer homeownership

A new national survey gauging attitudes toward housing finds that two-thirds of Americans (65 percent) still prefer owning a home, despite the challenging economic environment and the housing downturn. The Fannie Mae National Housing Survey, conducted between December 2009 and January 2010, polled homeowners and renters to assess their confidence in homeownership as an investment, the current state of their household finances, views on the U.S. housing finance system, and overall confidence in the economy.

The survey revealed that homeowners and renters alike are taking a more cautious approach to homeownership. Nearly a quarter of renters polled (23 percent) said they will buy a home later than once planned. In addition, Americans with traditional, fixed-rate mortgages with predictable payments are significantly more satisfied than those with other types of mortgages. Respondents cited non-financial reasons such as safety (43 percent) and quality of local schools (33 percent) as driving factors in wanting to own a home, ahead of financial considerations. A majority of consumers (60 percent) believe that buying a home today is harder than it was for their parents, and nearly seven in 10 (68 percent) think it will be even more difficult for their children. Most respondents (88 percent) also believe that walking away from an underwater mortgage is not acceptable, but those who know someone who has defaulted are more than twice as likely to have seriously considered stopping payments on their mortgage.

Jackson's artwork will be exhibiting 10 photographs of the Greek Islands. The other two artists are oil painters. There is also an Architectural Walking Tour each Saturday morning because of its architectural awards. Other events will be scheduled in the future.

Fair Housing Month


April 2010 marks the 42nd anniversary of the 1968 landmark Fair Housing Act. Each year REALTORS recognize the significance of this event and reconfirm our commitment to upholding fair housing law as well as our commitment to offering equal professional service to all in their search for real property.

Things you and your REALTOR Association can do to recognize Fair Housing Month:


  • Sponsor a local Fair Housing Month poster contest. Afterward, make association calendars out of the artwork.

  • Publish the REALTOR® Fair Housing Declaration and post it in your office and/or association.

  • Use the Fair Housing Proclamation and have your local government proclaim April as Fair Housing Month.

  • Display your 2010 Fair Housing FOCUS poster in your office and/or association.

  • Distribute the 2010 April Fair Housing Focus Publication.
